1. Acceptance of these Terms

These Terms & Conditions (“Terms”) are a binding agreement between you and Scoop Twin Falls (“Scoop Twin Falls,” “we,” “us,” or “our”) governing your access to and use of twinfallspetwasteremoval.com, related APIs, customer accounts, booking tools, and pet waste removal services (the “Services”).

By accessing the website, creating an account, submitting a booking (including guest checkout), or receiving services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

2. Eligibility and authority

  • You must be at least 18 years old and able to form a binding contract under U.S. law.
  • If you book for a property you do not own, you represent you have authority to grant access and authorize service on that property.
  • Business/HOA customers represent they have authority to bind the organization they name.

3. Description of services

We provide pet waste removal and related yard scooping for residential and certain commercial/HOA properties primarily in Twin Falls, Idaho and nearby Magic Valley service areas listed on our site. Service details, starting prices, and coverage may change. Estimates shown in booking are estimates unless we expressly confirm a fixed price in writing.

Visits occur during scheduled windows. Exact arrival time within a window is not guaranteed. Weather, safety, access issues, road conditions, or schedule conflicts may require rescheduling.

4. Accounts and security

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Provide accurate information and update it promptly. Notify us of suspected unauthorized use. We may suspend or terminate accounts for violations, fraud risk, or abuse.

5. Bookings, changes, and cancellations

  • A booking request is an offer to purchase services. We may accept, decline, or require changes based on capacity, service area, or safety.
  • You agree the service address, dog count, access notes, and schedule you submit are accurate.
  • Recurring plans continue until cancelled according to the method we provide in your account or by written notice we accept.
  • Cancellation or reschedule requests should be made as early as possible. Late cancellations, no-shows, locked gates, aggressive animals, or unsafe conditions may result in a visit fee, reschedule fee, or forfeiture of prepaid amounts as disclosed at booking or in a subsequent notice.
  • Same-day availability is not guaranteed and depends on the live calendar.

6. Property access, pets, and safety

  • You must provide lawful access (unlocked gates, working codes, cleared hazards) during the service window.
  • Secure pets as needed so our crew can work safely. Warn us about known aggressive animals, wildlife, or property hazards.
  • You authorize us to enter designated outdoor areas to perform scooping and to take before/after photos for quality/proof when that feature is used.
  • We may refuse or stop a visit if conditions are unsafe, illegal, or prevent proper performance.
  • Waste is typically bagged for your trash unless otherwise agreed. Follow HOA/trash rules applicable to your property.

7. Pricing, taxes, and payment

Prices, surcharges, and promotions are described on the site or in your quote and may change prospectively. You authorize us and our payment processors to charge the payment method you provide for amounts due, including applicable taxes and disclosed fees. Failed payments may pause recurring service. Chargebacks made in bad faith may result in account termination and collection of amounts owed to the extent permitted by law.

8. Communications

You consent to receive service-related emails, in-app messages, and (if you opt in) SMS about bookings and support. Marketing messages are optional and can be opted out as described in the Privacy Policy. Standard carrier rates may apply to SMS.

9. Acceptable use of the website

You agree not to:

  • Violate any law or third-party rights.
  • Attempt unauthorized access, scrape, reverse engineer, or overload our systems.
  • Upload malware or abusive content; harass staff or other users.
  • Impersonate others or submit false booking/payment information.
  • Use the Services to compete unfairly or build a competing dataset.

10. Intellectual property

The site design, logos, text, software, and content are owned by Scoop Twin Falls or its licensors and protected by U.S. intellectual property laws. You receive a limited, revocable, non-exclusive license to use the site for personal or internal business booking purposes. No other license is granted.

11. Disclaimers

EXCEPT WHERE PROHIBITED BY LAW, THE SERVICES AND WEBSITE ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION, OR THAT EVERY YARD CONDITION WILL BE FULLY DETECTED OR REMEDIATED IN A SINGLE VISIT.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY IDAHO AND U.S. LAW, SCOOP TWIN FALLS AND ITS OWNERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOST PROFITS, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THE SERVICES WILL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE SPECIFIC VISIT(S) GIVING RISE TO THE CLAIM IN THE THREE (3) MONTHS BEFORE THE EVENT, OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted.

13. Indemnification

You agree to defend, indemnify, and hold harmless Scoop Twin Falls and its personnel from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms, inaccurate information, unauthorized property access grants, dangerous conditions you failed to disclose, or misuse of the Services — except to the extent caused by our willful misconduct.

14. Suspension and termination

We may suspend or terminate access or service for violations, non-payment, safety risks, or operational reasons. You may stop using the Services and cancel eligible plans as described in your account. Sections that by nature should survive (including payment obligations, IP, disclaimers, liability limits, indemnity, and governing law) will survive termination.

15. Governing law and disputes (Idaho, USA)

These Terms are governed by the laws of the State of Idaho, without regard to conflict of law rules, and applicable U.S. federal law. Except where prohibited, exclusive venue for disputes that proceed in court will be the state or federal courts located in Twin Falls County, Idaho, and you consent to personal jurisdiction there.

Before filing a formal claim, you agree to try to resolve the dispute informally by contacting us at legal@twinfallspetwasteremoval.com and allowing 30 days for a good-faith response.

Class action waiver (where enforceable): you and Scoop Twin Falls agree to bring claims only in an individual capacity and not as a plaintiff or class member in any purported class or representative proceeding, to the fullest extent permitted by law.

Nothing in these Terms limits non-waivable consumer rights under Idaho or federal law, including rights related to personal injury caused by our negligence where such limitations are prohibited.

16. Miscellaneous

  • If any provision is unenforceable, the remainder stays in effect.
  • Our failure to enforce a provision is not a waiver.
  • You may not assign these Terms without our consent; we may assign to an affiliate or successor.
  • These Terms plus the Privacy Policy and any written job-specific confirmation are the entire agreement for the Services.
  • Headings are for convenience only.
  • Electronic acceptance (clicking agree, creating an account, or submitting a booking) has the same effect as a physical signature under the U.S. E-SIGN Act and Idaho’s Uniform Electronic Transactions Act, where applicable.
